The year 2026 marked a period of implementing several key reforms within the legal system of Turkmenistan. The new regulations cover civil-law relations, administrative liability, the migration system, virtual assets, and a number of other areas.
These new legislative provisions are aimed at further improving the rights and obligations of citizens, the operating principles of state bodies, and the rules governing economic relations.
The New Civil Code (Effective January 1, 2026)
On January 1, 2026, the new Civil Code of Turkmenistan entered into force.
The new code replaces the previous Civil Code, which had been in effect since 1998 and underwent several amendments over the years. The new document regulates property relations and related personal non-property legal relations.
Key features of the new code:
it applies to legal relations that arose after January 1, 2026;
for obligations remaining from prior periods, the new rules apply only to rights and obligations arising after that date;
previous legislative provisions conflicting with the new code lose their validity.
This change is highlighted as one of the largest innovations in Turkmenistan's civil law in recent years.
Amendments to the Code of Administrative Offenses
On April 11, 2026, the President of Turkmenistan signed a law introducing amendments to the Code of Administrative Offenses. The new rules entered into force on May 1.
Main amendments:
Liability for Children Smoking: Administrative liability was introduced for parents who allow children under the age of 16 to smoke. Under this rule, a fine is set at 1 to 2 base units.
Increased Fines for Driving While Intoxicated: According to the new amendments:
the fine for transferring vehicle operation to an intoxicated person was increased from the previous 6 base units to 10 base units;
fines for driving while intoxicated without a driver's license were also strengthened.
Prohibition on Accepting Passports as Collateral: According to the new rules, accepting a citizen's passport as collateral is directly prohibited by law. For violating this requirement, fines are stipulated in the amount of:
for citizens – 1 to 2 base units;
for officials – 5 base units;
for legal entities – 6 base units.
Furthermore, liability was intensified for driving without required documents, disseminating false advertising on the internet and mass media, and engaging in illegal medical and pharmaceutical activities.
Amendments to the Law "On Migration"
In April 2026, several important amendments concerning the migration system of Turkmenistan were adopted.
The new rules:
expand the list of grounds for registering foreign citizens and stateless persons;
transfer registration, term extension, and deregistration processes into electronic format through the information system of the State Migration Service;
clarify the rules regarding the registration of minors and tourists;
add new deregistration grounds, such as the restoration of Turkmenistan citizenship.
These amendments aim to digitalize migration services and simplify administrative procedures.
New Law "On Virtual Assets"
On January 1, 2026, the Law "On Virtual Assets" entered into force.
This is Turkmenistan's first legislative act specifically regulating the digital assets sector.
The law:
legally regulates cryptocurrency mining and exchange;
introduces a licensing system for crypto-exchanges;
transfers supervision in this area to the authority of the Central Bank of Turkmenistan.
At the same time, virtual assets are not recognized as:
a means of payment;
currency;
a security.
Other Legislative Innovations
In 2026, amendments were also introduced across several other areas:
updates concerning the law "On Fisheries and Protection of Aquatic Biological Resources";
changes in the licensing system for certain types of activities;
new rules regarding bookkeeping and financial reporting;
updating legal acts related to highways and road activities.
The year 2026 became one of the periods of modernization for Turkmenistan’s legislative system. The most important innovations encompass:
civil law – entry into force of the new Civil Code;
administrative liability – new fines and prohibitions;
migration system – expansion of electronic services;
digital economy – legal regulation of virtual assets.
Citizens and enterprises are advised to continuously familiarize themselves with the new regulations.
