Procedure for Granting Land to Individuals, Organizations and Institutions in Turkmenistan

In accordance with Article 16 of the Land Code of Turkmenistan, land plots are granted to individuals, legal entities of Turkmenistan and foreign states, as well as to foreign states and international organizations, in the following manner:

1. Citizens of Turkmenistan wishing to obtain a land plot shall submit an application at the location of the land plot to the following authorities:

a) for private ownership — for conducting a personal subsidiary farm (household plot) and for the construction of an individual residential house — to the Gengeshi (local council) or the city district khyakimlik;

b) for use — to the relevant state authority for land resources management;

c) for lease:

• irrigated land — to a peasant association or other agricultural enterprise;

• for non-agricultural purposes — to the relevant state authority for land resources management.

1. Legal entities of Turkmenistan requiring land plots for use or lease shall submit an application to the relevant state authority for land resources management at the location of the land plots.
2. Applications of citizens of Turkmenistan and requests of legal entities for the allocation of land plots shall indicate the intended purpose, size and location of the requested land plots and be accompanied by documents justifying the necessity of granting the land.
3. The procedure for submitting and reviewing applications and requests of citizens of Turkmenistan and legal entities for granting land plots for ownership, use or lease shall be established by the Cabinet of Ministers of Turkmenistan.
4. Foreign citizens and legal entities, as well as foreign states and international organizations wishing to lease land plots, shall submit applications to the Cabinet of Ministers of Turkmenistan.
5. Granting land plots for use to citizens and legal entities of Turkmenistan, leasing land plots for non-agricultural purposes, and granting land plots into private ownership to families of citizens of Turkmenistan for the construction of individual residential houses shall be carried out based on the decision of the State Commission on Land Issues.
6. Granting land plots into private ownership to families of citizens of Turkmenistan for personal subsidiary farming (household plots) shall be carried out in accordance with the decision of the district (city) khyakimlik.
7. Formalization of land plot allocation with the issuance of documents certifying ownership, use and lease rights for non-agricultural purposes shall be carried out by the state authority for land resources management in accordance with the legislation of Turkmenistan. State registration of these rights shall be performed by the local offices of the Service for State Registration of Rights to Immovable Property and Related Transactions under the Ministry of Justice of Turkmenistan.
